MOENV Preannounces Stricter Permit Controls for Water Pollution Violators

On September 22, 2025, the Ministry of Environment (MOENV) preannounced amendments to the Regulations Governing Water Pollution Control Measure Plans and Permit Application Reviews. The amendments aim to enhance permit management for enterprises and sewage systems involved in major violations of the Water Pollution Control Act, such as illegal discharge rerouting, insufficient treatment facilities, or failure to maintain operations. The validity period of permits will be shortened to a maximum of three years, and this period will remain unchanged even if modifications are made. The new rules are intended to prevent recurring pollution and ensure tighter permit oversight.

To address persistent pollution in moderately or severely polluted rivers, the revised regulations require non-compliant enterprises to reduce their approved daily wastewater discharge and production scale to no more than 80% of the original permitted quantity. Additionally, these enterprises are prohibited from applying for increased capacity for three years from the approval date. This move aims to protect river ecosystems, give polluted water bodies time to recover, and deter enterprises from illegal operations by reinforcing accountability and stricter regulatory enforcement.
